What are the Florida Cultivation Laws?
To be eligible for an MTC license, applicants must demonstrate the technical and technological ability to cultivate marijuana, secure their premises, and maintain accountability for all cannabis products. This includes following state rules such as using Department of Health-approved pesticides and ensuring that marijuana is grown in an enclosed, restricted area.
All staff employed by MTCs must be over 21 years old, pass a level 2 background check, and receive proper training on cannabis cultivation. Individuals with prior criminal records or felonies, however, are not allowed to work in these facilities. The Florida Department of Health limits new licenses based on the number of registered medical marijuana patients, making the process highly competitive and regulated.
How Do You Obtain a Florida Cannabis Cultivation License?
To obtain a Florida cultivation license, applicants must first apply for a Medical Marijuana Treatment Center (MTC) license. The application process is overseen by the Florida Department of Health and involves completing the Application for Medical Marijuana Treatment Center Registration Form which includes several requirements:
- A non-refundable application fee of $60,830.
- Proof of operating a Florida-registered business for at least five years.
- A valid Department of Agriculture and Consumer Services certificate of registration.
- A list of owners, managers, and officers, along with completed background checks.
Once submitted, applications are evaluated by a team of subject matter experts, who score them based on:
- Technical and technological ability to cultivate cannabis.
- Capacity to secure the premises and prevent unauthorized access.
- Experience in managing regulated operations.
Priority is given to applicants with experience in citrus processing or those previously denied a license under past regulations. Successful applicants must also, within ten days of approval:
- Post a $5 million performance bond or provide financial assurance.
- Provide documentation backing up claims of property ownership or leases.
This process ensures only qualified organizations can legally cultivate cannabis in Florida.
Compliance: Florida’s Seed-to-Sale Tracking System
The Florida seed-to-sale tracking system for medical cannabis, powered by BioTrack, launched in the summer of 2024. This system serves as a state reporting tool with an Application Programming Interface (API) to submit data and generate unique barcodes (UUIDs). Historically, Florida’s cannabis tracking system relied on self-reporting, except for final retail sales, which are submitted to the Medical Marijuana User Registry (MMUR).
