Illinois Seed To Sale: Marijuana Cultivation Laws and Licenses

Since the passage of the Illinois Cannabis Regulation and Tax Act in 2019, there has been a surge in Illinois seed-to-sale cannabis operations. With a focus on public health and safety, the state tightly regulates medical and recreational cultivation licensing, ensuring that growers meet strict guidelines for security, environmental standards, and product quality.

Licenses for Cannabis Cultivators in Illinois

Under the Cannabis Regulation and Tax Act, cannabis cultivators in Illinois must obtain a license from the Illinois Department of Agriculture. There are three license types:

  • Medicinal Cultivation Center License:

Granted only to entities growing cannabis for medical dispensaries and patients in Illinois’ medical marijuana program, license holders can grow plants, produce extracts, manufacture infused products, and sell wholesale and transport to other licensed medical cannabis businesses.

  • Adult-Use Cultivation Center License:

Similar to medical cultivation center licenses, these allow organizations to grow plants, produce extracts, and manufacture infused products for recreational use. Adult-use cultivation centers may have up to 210,000 square feet of canopy space.

  • Craft Grower License:

Allows holders to cultivate, dry, cure, and package cannabis in facilities with 5,000 to 14,000 square feet of canopy space. License holders can sell wholesale to other licensed cannabis businesses and may be licensed as processors (infusers) and dispensaries in the same facility.

Who Can Obtain a Cannabis Cultivation License in Illinois?

Only specific individuals and businesses in Illinois can obtain grow licenses for cannabis cultivation:

Patients and Designated Caregivers: Individuals with valid medical cannabis cards can grow up to five cannabis plants over five inches tall. These plants must be cultivated in a secure, locked space, out of public view, either in the patient’s home or at a location with the property owner’s consent.

Licensed Commercial Growers: Adult-use cannabis can only be grown by licensed commercial entities, which include craft grower operations, existing medical cannabis cultivation organizations, and adult-use cultivation centers.

New Market Entrants: Those new to the market can apply for a conditional adult-use cultivation center license. This license does not permit immediate cultivation but rather reserves a spot for full licensing upon meeting state conditions.

The CRTA prohibits adults from growing cannabis for personal use. Violating this law results in a $200 fine. Personal-use marijuana must be purchased legally from licensed dispensaries.
