Massachusetts Seed-To-Sale Laws and Cultivation Information

There are multiple different types of licenses available for Massachusetts seed to sale, each with their own requirements and application fees depending on the role. These license types include:

• Marijuana Cultivation License – Cultivator licensees may grow, process, and package marijuana for delivery to marijuana establishments, but not consumers. These licenses are broken down into tiers based on the size of an operator’s canopy, measured by square feet, which ranges from Tier 1 to Tier 11.

• Craft Marijuana Cooperative License – This rather unique license allows operators to obtain, grow, manufacture, brand, process and package marijuana and marijuana products for delivery to other licensed marijuana establishments, but not consumers.

• Marijuana Product Manufacturer License – This entity authorizes the ability to obtain, grow, manufacture, process, and package marijuana and marijuana products to MEs, as well as transfer products to other MEs, but not consumers.

• Cannabis Dispensary / Marijuana Retailer License – A marijuana retailer license authorizes the purchasing, repackaging, white labeling, and transporting of marijuana and products from other MEs, as well as selling, packaging, and transferring of marijuana and products to MEs, as well as consumers.

• Transporter License – Licensed transporters are authorized to ship and transport marijuana between licensed MEs, but not consumers.

• Marijuana Research Facility License – These licensees can consist of academic institutions, non-profit corporations, domestic corporations, or other entities authorized to do business in Massachusetts. A marijuana research facility may cultivate, purchase, or acquire marijuana for the purpose of conducting research regarding marijuana and such products.

• Marijuana Testing License – An Independent Testing Laboratory, or ITL, is an entity that is properly accredited to perform tests on marijuana products in compliance with the requirements of the CCC’s protocols.

• Standards Testing Laboratory – This is an entity that would otherwise qualify to be an ITL, but instead performs blind tests to verify results of ITL’s for the commission.

• Microbusiness License – These are small-scale operations licensed to cultivate with Tier 1 canopies and manufacture with limitations on productions and purchasing.

• Marijuana Delivery Operator License – These licensees may purchase marijuana at wholesale or warehouse finished marijuana and products from a cultivator, product manufacturer, microbusiness, or craft marijuana cooperative to sell and deliver directly to consumers.
