Nevada Cultivation License and Marijuana Laws

Medical marijuana was legalized in Nevada in 2001 and began its real program journey in 2015. In 2016, citizens of Nevada voted to legalize the recreational use of marijuana and, at which time, permitted purchase, possession, and consumption for adults that were over 21.

As of 2019, there were over 60 dispensaries in the state, the most being in Clark County, where Las Vegas is located. Here are some details about the Nevada cultivation license in Nevada’s advanced marijuana market.

Medical vs. Recreational

A recreational marijuana cultivation facility is an entity licensed to cultivate, process, and package marijuana, to have marijuana tested by a marijuana testing facility, to sell marijuana to retail marijuana stores, product manufacturing facilities, and other marijuana cultivation facilities, but not to consumers.

The recreational laws define a batch as:

“Usable flower and trim contained within one or more specific lots of marijuana grown by a marijuana cultivation facility from one or more seeds or cuttings of the same strain of marijuana and harvested on or before a specified final date of harvest.”

And the batch number as:

“A unique numeric or alphanumeric identifier assigned to a batch by a marijuana establishment when the batch is planted.”

The medical marijuana laws define batch the same as the recreational laws. However, a cultivation facility is more specifically defined as a facility that acquires, possesses, cultivates, delivers, transfers, transports, supplies, or sells marijuana and related supplies to medical dispensaries, facilities to produce edible marijuana products or marijuana-infused products or other cultivation facilities.

Handouts

All handouts must be disclosed (including samples), and all soil amendments, fertilizers, crop production aids, and growing mediums included in the lot, as well as the facility that tested the product, should be available information. Any samples packaged (jar for smells) should be less than 3 ½ grams, may not be sold, and must be destroyed after use.

Quality Control

Each cultivation facility should have a quality control unit that is responsible for checking containers, packaging, and the product in general. The hygiene of the facility should always be upheld, and the building should be properly built in accordance with administrative code 453A.606.

Types of Nevada Grow Licenses

Cultivation facility licensees are permitted to cultivate (grow), process, and package marijuana; to have marijuana tested by a testing facility; and to sell marijuana to retail marijuana stores, to marijuana product manufacturing facilities, and other cultivation facilities, but not to consumers.

To purchase a Nevada marijuana cultivation license, a one-time application fee of $5,000 is required.

The Department may require payment of an annual licensing fee not to exceed:

  • or the initial issuance of a license for a marijuana cultivation facility: $30,000
  • For a renewal license for a marijuana cultivation facility: $10,000
  • For the initial issuance of a license for a marijuana product manufacturing facility: $10,000
  • For a renewal license for a marijuana product manufacturing facility: $3,300

Nevada Commercial Grow License Application Requirements

The Department is not currently accepting applications for marijuana licenses or medical marijuana registration certificates.

Nevada Seed-to-Sale State Tracking System

Nevada has contracted Metrc as the mandatory regulatory tracking system. Metrc is a seed-to-sale tracking system that uses serialized tags attached to every marijuana plant — and labels attached to wholesale packages — to track marijuana inventory. Each tag is attached to a plant to facilitate tracking through different stages of growth, as well as the drying and curing processes, and eventual retail sale.

Third-Party Integration
